  1. This resolution shall apply to all lands within the jurisdiction of the County of Douglas Nebraska identified on the Flood Insurance Rate Map (FIRM) dated March 19, 2007 and any revisions hereto, as numbered and unnumbered A Zones (including AE, AO, and AH Zones) and within the Zoning Districts FW and FF established in Section 8.05.D.2 of this resolution.

    In all areas covered by this resolutions, no development shall be permitted except upon the issuance of a floodplain permit to develop, granted by Douglas County, Nebraska or its duly designated representative under such safeguards and restrictions as Douglas  County, Nebraska or the designated representative may reasonably impose for the promotion and maintenance of the general welfare, health of the inhabitants of the community and where specifically noted in this section and in Sections 8.05 K and L.
  2. This resolution creates two zoning districts which are additional to other zoning districts of the County: A floodway overlay district (FW) and a floodfringe overlay district (FF) as identified in the Flood Insurance Study and accompanying maps.

    The zoning districts created by this resolution overlie other zoning districts and place additional restrictions upon the manner in which lands in such underlying district may be used. Within these districts all uses not meeting the standards of this resolution and those standards of the underlying zoning district shall be prohibited.
  3. The Planning & Zoning Coordinator of the community is hereby designated as the community's duly designated Enforcement Officer under this Resolution.
  4. The physical boundaries of the zoning districts created hereunder shall be determined by scaling distances on the appropriate official map. Where uncertainty exists as to the boundary of a zoning district created by this resolution, the regulatory flood elevations for the point in question shall be the governing factor in resolving the issue. Dimensions contained in the Flood Insurance Study shall control in the demarcation of the floodway zoning district. Disputes shall be resolved by the Douglas County Board of Adjustment. Section D.1 of the Douglas County Zoning Resolution shall not apply to this resolution.
  5. Within identified special flood hazard areas of this community, no development shall be located, extended converted or structurally altered without full compliance with the terms of this resolutions and other applicable resolutions.
  6. This resolution takes precedence over any conflicting statutes, resolutions, ordinances or resolutions which are less restrictive in their provisions pursuant to 23-170, R.R.S. 1943.
  7. In their interpretation and application, the provisions of this resolution shall be held to be minimum requirements and shall be liberally construed in favor of the governing body and shall not be deemed a limitation or repeal of any other powers granted by state statutes. The specific prohibition of certain uses or practices is not to be interpreted as authorizing others by implication.
